Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Arcubix website, applications, and related services (collectively, the "Service") operated by YerassylSystems LLP, Business Identification Number (BIN) 260240007175 ("YerassylSystems", "we", "us", or "our"). The Service is offered to users in the United States and worldwide.

By accessing or using the Service from any country, creating an account, or clicking to accept these Terms, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization. You are responsible for ensuring your use complies with laws that apply to you locally.

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. By using the Service, you represent that you meet this requirement and that your use complies with all applicable laws.

We may refuse, suspend, or terminate access to anyone at any time for any reason permitted by law, including violation of these Terms.

You may sign in through third-party identity providers (such as GitHub or Google). You are responsible for maintaining the security of your credentials and for all activity under your account.

You agree to provide accurate profile information and to keep it reasonably up to date. You may not impersonate others, misrepresent affiliation, or create accounts through unauthorized automated means.

We may suspend or delete accounts that are inactive, fraudulent, abusive, or that violate these Terms.

"User Content" means any text, images, links, projects, posts, comments, messages, profiles, and other materials you submit, post, or display through the Service.

You retain ownership of your User Content. By submitting User Content, you grant YerassylSystems a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and otherwise use your User Content solely to operate, improve, promote, and provide the Service — including making public posts and profiles visible to other users and search engines where you choose to publish publicly.

You represent and warrant that you own or have all rights necessary to submit your User Content and that your User Content does not violate any law or third-party rights.

We do not endorse User Content and are not responsible for opinions, advice, or statements posted by users.

You agree not to:

• Violate any applicable law, regulation, or third-party rights
• Post malware, spam, phishing, harassment, hate speech, illegal content, or content that exploits minors
• Scrape, crawl, or harvest data from the Service except through documented APIs we expressly permit
• Attempt to gain unauthorized access to accounts, systems, or data
• Interfere with or disrupt the Service, including through excessive automated requests or denial-of-service activity
• Reverse engineer, decompile, or attempt to extract source code except where legally permitted
• Use the Service for unsolicited commercial messaging or deceptive practices
• Circumvent rate limits, security measures, or access controls

We may (but are not obligated to) monitor, review, remove, or restrict User Content or accounts at our sole discretion, with or without notice, if we believe content or conduct violates these Terms, creates risk, or harms the Service or others.

You can delete your own posts and projects through in-product controls where available. Some copies may persist in backups for a limited period.

The Service integrates with and links to third-party services (including OAuth providers, reCAPTCHA, Product Hunt, and external websites). Those services are governed by their own terms and privacy policies.

We are not responsible for third-party services, content, or practices. Your use of them is at your own risk.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YERASSYLSYSTEMS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that User Content or results will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL YERASSYLSYSTEMS, ITS PARTNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YERASSYLSYSTEMS'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100 (ONE HUNDRED US DOLLARS).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless YerassylSystems and its partners, members, officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.

You may stop using the Service at any time. We may suspend or terminate your access immediately, with or without notice, for any reason, including breach of these Terms.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

The Service is provided globally. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Before filing a claim, you agree to contact us at yerassylsystems@outlook.com and attempt to resolve the dispute informally for at least thirty (30) days.

Except where prohibited by applicable law, any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Delaware, United States, and you consent to personal jurisdiction and venue in those courts.

Nothing in these Terms limits any non-waivable rights you may have under the laws of your place of residence, including consumer protection statutes in the U.S., EEA, UK, or other jurisdictions.

We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. Material changes may also be communicated through the Service.

Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and YerassylSystems regarding the Service.

If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.

You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
